Welcome to Le Magasin Littéraire. By using our platform, you agree to these terms. Key points include: You retain ownership of your work, but grant us a license to display it permanently. We do not tolerate AI-generated content or plagiarism. Members pay in Canadian Dollars with automatic renewal. You can publish your work elsewhere anytime. We may update these terms, and continued use implies acceptance. Violations may result in account termination.

These Terms of Service govern your use of our platform and membership services. By creating an account or subscribing, you agree to these terms. We’ve written them to be as clear as possible while protecting both your rights and ours.

Acceptance of All Policies

By accepting these Terms of Service, you agree to be bound by all Le Magasin Littéraire policies and legal documents, including but not limited to:

  • Terms of Service (this document)
  • Privacy Policy – governing collection, use, and protection of your personal information
  • Artificial Intelligence Policy – establishing rules for AI use in content creation and submission
  • Compensation & Membership Policy – detailing our membership model, contributor compensation structure, and cashback guarantee system
  • Refund Policy – detailing circumstances under which refunds may be issued
  • Publication Agreement – specific contract terms for contributors whose work is accepted for publication
  • Community Guidelines – standards of conduct for participation in LML community features
  • Cookie Policy – disclosure of cookies and tracking technologies used on our platform

These policies collectively form the complete agreement between you and Le Magasin Littéraire. Your use of our services constitutes acceptance of all current and future versions of these policies. We will notify you of material changes to any policy, but your continued use of LML after such notice constitutes acceptance of the updated terms.

Violation of any policy may result in consequences as outlined in Section 6 (Enforcement & Consequences), including account suspension or termination.

Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Le Magasin Littéraire (“LML,” “we,” “us,” or “our”). By accessing or using our website, creating an account, or purchasing a membership, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1.1 Eligibility

You must be at least 18 years old to create an account or purchase a membership. By using our services, you represent and warrant that you meet this requirement and have the legal capacity to enter into this agreement.

1.2 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through a prominent notice on our website. Your continued use of our services following such notification constitutes your acceptance of the modified Terms.

Membership & Subscriptions

Le Magasin Littéraire offers subscription-based memberships providing access to exclusive literary content, workshops, community features, and special events.

2.1 Membership Tiers

We offer various membership tiers, each with different benefits and pricing. Complete details of membership benefits are available on our Membership page. Pricing is stated in Canadian Dollars (CAD) and is subject to applicable taxes. For international members, your payment provider will automatically convert the amount to your local currenc

2.2 Billing and Renewals

Memberships are billed on a recurring basis (monthly or annually, depending on your selection). Your membership will automatically renew at the end of each billing period unless you cancel prior to the renewal date. You authorize us to charge your payment method for the applicable membership fee upon renewal.

2.3 Cancellation

You may cancel your membership at any time through your account settings or by contacting us at support@lemagasinlitteraire.com. Cancellations take effect at the end of your current billing period. You will retain access to membership benefits until that date.

2.4 Refund Policy

Membership fees are non-refundable except as required by applicable law or as stated in our Refund Policy. If you believe you are entitled to a refund due to extenuating circumstances, please contact us within 7 days of your charge.

2.5 Workshops and Contests

Separate fees may apply for workshops and contest entries. These fees are generally non-refundable once the workshop begins or the contest entry period closes, except in cases where we cancel the event or as otherwise stated in the specific terms for that offering.

Content Rights & Intellectual Property

3.1 Our Content

The Le Magasin Littéraire name, logo, website design, graphics, and proprietary content created by LML are protected by copyright and other intellectual property laws and remain the exclusive property of Le Magasin Littéraire.

3.2 Published Works by Contributors

All literary works, essays, stories, poems, articles, and other creative content published on Le Magasin Littéraire are the copyrighted property of their respective authors. Contributors retain full copyright ownership of their work.

You Own It

You retain any and all of your rights to any content you submit, post, or display on or through Le Magasin Littéraire, and you are responsible for protecting those rights. We do not claim ownership of your work.

We Display It

By publishing on Le Magasin Littéraire, you grant us the right and license to use, modify, perform, display, reproduce, and distribute your work on and through our platform.

3.3 Publishing License & Rights

By submitting work for publication on Le Magasin Littéraire, contributors grant us a non-exclusive, irrevocable, worldwide, perpetual license to publish, display, reproduce, and distribute their work on our platform. This license includes:

  • Permanent display on the LML website and mobile applications
  • Distribution to LML members via email or digital delivery
  • Promotion on social media and in marketing materials with proper attribution
  • Inclusion in curated collections, anthologies, or special editions (with advance notice to the author)

This license does not transfer copyright ownership. Authors retain all rights to their work and are free to republish it elsewhere, simultaneously or at any time, without restriction or permission from LML. We require only that authors credit first publication to Le Magasin Littéraire when republishing.

3.4 No Retraction Policy

Once a work is published on Le Magasin Littéraire, it becomes part of our permanent literary archive and cannot be retracted or removed by the author, except in the following extraordinary circumstances:

  • Proven plagiarism or copyright infringement
  • Court order or valid legal requirement
  • Credible safety or security threat to the author or others
  • Mutual agreement between the author and LML editorial team in cases of significant factual error or other compelling reason

This policy protects the integrity of our publication, ensures consistency for our members, and maintains the value of our curated literary archive.

3.5 Publication Agreement

All contributors must sign a Publication Agreement prior to their work appearing on LML. This agreement specifies compensation terms, attribution requirements, moral rights, and editorial parameters. By signing, authors acknowledge their understanding of and consent to this No Retraction Policy.

3.6 Simultaneous & Subsequent Publication

Authors are free to submit their work to other publications before, during, or after publication on LML. We do not require exclusivity. We ask only that authors:

  • Inform us if a work is under consideration elsewhere at the time of submission
  • Credit Le Magasin Littéraire as the original or co-publisher when republishing
  • Notify us of any rights conflicts that may arise with other publishers

3.7 Moral Rights

Authors retain all moral rights to their work, including the right to be identified as the author and to object to derogatory treatment of their work. We will always attribute work to its author and will not modify published work in ways that would prejudice the author’s honor or reputation without their consent.

3.8 Member License & Restrictions

As a member, you are granted a limited, non-exclusive, non-transferable license to access and read published content for your personal, non-commercial use only. You may not:

  • Reproduce, distribute, or publicly display any published content without express written permission from the copyright holder
  • Use published works for commercial purposes
  • Modify, adapt, or create derivative works from published content
  • Share your account credentials or access with non-members
  • Use automated systems to scrape, download, or archive content in bulk

Members may quote brief excerpts (up to 300 words) for purposes of criticism, commentary, or review, provided they include proper attribution and a link to the original work on LML.

3.9 User-Submitted Content (Non-Published)

If you submit content to LML that is not selected for publication (such as workshop submissions, contest entries, community forum posts, or comments), you retain full copyright ownership. You grant us only a limited license to review, evaluate, and use such submissions for the stated purpose (workshop feedback, contest judging, etc.). We will not publish or distribute non-selected submissions without your explicit consent.

3.10 Permissions & Reproductions

Requests to reproduce or republish content from Le Magasin Littéraire must be directed to the original author for their approval. We may facilitate introductions but cannot grant permission on behalf of contributors. For LML’s proprietary content, contact permissions@lemagasinlitteraire.com.

3.11 Copyright Infringement Claims

If you believe content on LML infringes your copyright, please contact us immediately at legal@lemagasinlitteraire.com with:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the infringing material and its location on our site
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner

We will investigate all claims promptly and take appropriate action, which may include removing the disputed content.

Artificial Intelligence Policy

Le Magasin Littéraire maintains a comprehensive Artificial Intelligence Policy (AI Policy) that governs the use of AI tools in content creation and submission. This policy is designed to preserve the integrity of human creativity while acknowledging legitimate uses of AI assistance.

Key provisions include:

  • Strict prohibition on AI-generated literary content (stories, poems, essays)
  • Requirements for disclosure of AI-assisted writing tools
  • Permission for AI-generated visual content (images, covers, illustrations)
  • Enforcement measures and detection protocols

All contributors and members must comply with our AI Policy, which is available at Artificial Intelligence Policy – Le Magasin Littéraire. Violation of the AI Policy may result in immediate account termination and permanent ban. See Section 6 (Enforcement & Consequences) for details.

We may update this policy as AI technology and literary standards evolve. Material changes will be communicated via email and posted on our website.

User Conduct & Community Guidelines

To maintain a respectful and productive literary community, we expect all members to conduct themselves appropriately. Prohibited conduct includes:

Harassment or abuse: Threatening, harassing, or abusive behavior toward other members or contributors.

Hate speech: Content promoting discrimination, hatred, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.

Spam or solicitation: Unsolicited commercial messages, advertisements, or repetitive content.

Impersonation: Falsely representing yourself as another person or entity.

Illegal activity: Using our platform for any unlawful purpose or encouraging illegal conduct.

Disruption: Interfering with other users’ access to or enjoyment of our services.

Plagiarism: Submitting or posting work that is not your own or that violates another person’s intellectual property rights.

Violation Consequences

We reserve the right to suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

Enforcement & Consequences

6.1 Violations & Penalties

Le Magasin Littéraire takes violations of these Terms seriously. Depending on the nature and severity of the violation, we may take one or more of the following actions:

Warning: For minor or first-time violations, we may issue a formal warning and request immediate compliance.

Content Removal: We may remove content that violates these Terms, our AI Policy, copyright laws, or community guidelines.

Account Suspension: Temporary suspension of account access for a specified period (typically 7-30 days), during which you cannot access member content or participate in community features.

Account Termination: Permanent closure of your account and revocation of all membership privileges.

Legal Action: In cases involving illegal activity, fraud, or significant harm, we reserve the right to pursue legal remedies and cooperate with law enforcement.

6.2 Specific Violation Consequences

AI-Generated Content Violations:

  • Submission of AI-generated literary work: Immediate account termination, permanent ban, forfeiture of all payments and publication credits
  • Failure to disclose required AI assistance: Content rejection, warning, or account suspension depending on severity
  • Repeated minor AI policy violations: Progressive discipline leading to termination

Copyright Infringement:

  • Plagiarism or submission of others’ work: Immediate account termination, removal of all published content, possible legal action
  • Unauthorized reproduction of LML content by members: Account termination, cease and desist notice, potential legal action for damages

Payment & Subscription Violations:

  • Chargebacks or payment fraud: Immediate account termination, collection proceedings for amounts owed
  • Account sharing: Warning for first offense, account termination for repeated violations
  • Unauthorized use of promotional codes: Revocation of benefits, account suspension or termination

Community Guideline Violations:

  • Harassment or hate speech: Immediate suspension (7-30 days) or termination depending on severity
  • Spam or commercial solicitation: Content removal, warning, or account suspension
  • Impersonation: Immediate account termination
  • Illegal activity: Immediate account termination and reporting to appropriate authorities

Breach of Publication Agreement:

  • Attempting to retract published work without valid grounds: Formal reminder of contractual obligations, potential legal action if author publishes content elsewhere claiming LML violated their rights
  • Failure to properly credit LML in subsequent publications: Request for correction, notation in author’s file

6.3 Process & Appeals

Notice: When we take action against your account, we will generally notify you via email with an explanation of the violation and the action taken, except in cases involving illegal activity or severe violations where immediate termination is warranted.

Appeals: If you believe enforcement action was taken in error, you may appeal by contacting legal@lemagasinlitteraire.com within 14 days of the action. Include:

  • Your account information
  • Description of the action taken
  • Explanation of why you believe it was in error
  • Any supporting documentation

We will review appeals in good faith and respond within 30 days. Our decision on appeals is final.

No Refunds for Violations: Account termination or suspension due to your violation of these Terms does not entitle you to a refund of membership fees, workshop payments, or any other charges.

6.4 Repeat Offenders

Users who repeatedly violate these Terms, even for different types of violations, may face escalated consequences including permanent termination regardless of the individual severity of each incident.

6.5 Right to Refuse Service

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion, even in the absence of a specific violation, if we believe in good faith that a user’s presence is detrimental to our community or platform integrity.

Limitation of Liability & Disclaimers

7.1 Service Availability

We strive to maintain continuous, uninterrupted access to our platform, but we cannot guarantee that our services will always be available or free from errors, delays, or technical issues. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

7.2 Content Accuracy

While we work with talented writers and editors, we make no warranties regarding the accuracy, completeness, or reliability of content published on our platform. Views expressed by contributors are their own and do not necessarily reflect the views of Le Magasin Littéraire.

7.3 Limitation of Liability

To the fullest extent permitted by law, Le Magasin Littéraire, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use our services.

Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

7.4 Indemnification

You agree to indemnify and hold harmless Le Magasin Littéraire and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your violation of these Terms or your use of our services.

Privacy & Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our privacy practices as described in the Privacy Policy.

General Provisions

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ottawa, Ontario.

9.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9.3 Entire Agreement

These Terms, together with our Privacy Policy, AI Policy, and any other policies referenced herein, constitute the entire agreement between you and Le Magasin Littéraire regarding your use of our services.

9.4 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

9.5 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
